Freebie Force Terms and Conditions of Use and Policies and Procedures

By proceeding with this application (or as a current member with FreebieForce), I agree that I have read and understand these statements. The Policies and Procedures of FreebieForce contained herein were established to explain and define the rights and responsibilities of FreebieForce and its Independent Representatives. Each Independent Representative agrees, without reservation, to all the terms and conditions contained herein and holds FreebieForce free from any and all liability that may result from this agreement between the Independent Representative and FreebieForce. Cancellation and Refund Policy FreebieForce Independent Representatives pay a $278.00 administration fee, which is non-commissionable, for one year Independent Representative status. This fee is waived for Freebieforce Members who choose to become customer / distributors. FreebieForce members must pay a monthly membership fee of $19.95 to maintain their membership and have rights and access to all products and services. Members who choose not to become distributors / Independent Representatives also have rights and access to all products and services, and may choose to become Independent Representatives / distributors from within our software at any time for no extra charge. All members recognize that the credit card they have on file will continue to be billed $19.95 every 30 days until and unless that member cancels his/her membership with FreebieForce. There is no long term commitment or timeframe in which a member must continue to remain active by paying their monthly membership fee. Members may cancel their membership at any time for any reason simply by logging into their FreebieForce online members and clicking on the User and Billing Info link where they are required to follow the Terminate Membership link to cancel their membership. No commissions can be earned by inactive members. To continue with FreebieForce as an Independent Representative, but without an active Membership, the $278.00 one year administrative fee must be paid. FreebieForce maintains a 3 day 100% refund policy. You must cancel your membership within 3 days of upgrading to member to be eligible for a refund. After you have been a member for 3 days, no refunds either partial or full are given. Refunds are only given if the 3 day eligibility requirement is met and if the refund is requested. To request a refund, you must send an email to support@freebieforce.com including your FreebieForce username or ID number. With regard to resigning or terminated Representatives in GA, LA, MA, MD, MT, OK, PR, TX, and WY, and to the extent the buy-back laws of those jurisdictions apply to unused portions of administration fees and Membership fees, all terms of those buy-back laws will be honored. Additionally, Montana Representatives who resign within 15 days are entitled to a 100% refund of any consideration given to participate. Anti-Spam Policy In order to protect our Independent Representatives and ensure the long term growth and success of FreebieForce, FreebieForce maintains a ZERO tolerance policy towards the sending of spam email. Spam email is defined as Unsolicited Commercial Email (UCE). In the event that you send spam email to people without their permission, you risk immediate cancellation of your account and forfeiture of all contacts in that account. As a FreebieForce Independent Representatives, you understand that FreebieForce neither condones nor tolerates the sending of unsolicited or spam email by its Independent Representatives. You understand and acknowledge that: By signing up with Freebie Force, you agree to receive email updates from us regarding our service. If you wish to opt out of these emails at any time, you may do so by clicking the "Opt-Out" link found at the bottom of our emails. You will automatically be sent a confirmation email confirming your email address, and you will begin receiving email from us when you have confirmed your email address and your interest in receiving email updates. Freebie Force is fully compliant with the can spam act. It is ILLEGAL to forge headers on emails and it is ILLEGAL to neglect to include a valid functional unsubscribe link along with a valid mailing address in any emails sent out. Anyone caught forging headers or not including a valid functional unsubscribe link will be immediately and permanently terminated from FreebieForce. FreebieForce also prohibits all Independent Representatives from including the name or website address in any emails they send out. Independent Representatives are required to use a redirect link when directing prospects to their landing page. We also require all Independent Representatives to download their list of email addresses that have generated a complaint that can be found in the Spam Policy link in the Independent Representative section of the FreebieForce website and permanently remove them from your database. If we receive a complaint from the same email address as a previous complaint from an email that was sent more than a week after the original complaint was filed, FreebieForce has the right to terminate your Independent Representative status. You are solely responsible for mail sent on your behalf. FreebieForce will immediately terminate your Independent Representative status and suspend all future commissions for violating these Spam Policies. FreebieForce reserves the right to take legal action against any Independent Representative found violating this Spam Policy. You will not be eligible for a refund if you are terminated for violating the FreebieForce Spam Policy. Product and Earnings Policy FreebieForce monthly membership fee is to pay for full access to the training products and educational material provided by FreebieForce and it's trainers. All active members may also participate in the FreebieForce compensation program as outlined on the Pay Plan page of the website. Commissions are paid as outlined on the Pay Plan page of the website. All Independent Representatives understand BEFORE paying their administration fee, or before becoming a Member that there are NO GUARANTEED EARNINGS. Independent Representatives should not participate in FreebieForce under the expectation of earning income without referring new Members. Neither FreebieForce, nor it's Representatives can guarantee "spillover" or earnings simply by becoming a Representative. Most Representatives earn less money each month in the compensation program than they are paying to maintain their Membership in FreebieForce, or recoup their administration fee, if not an active Member. Although it is possible, FreebieForce Representatives should NOT expect to make a profit simply by becoming a Representative as it is highly unlikely that will occur. No Representative should spend money that they cannot afford to lose to become a Representative, either by maintaining their membership in FreebieForce, or paying the one year administration fee. It is possible that you will NOT earn income as a Representative of FreebieForce. All Independent Representatives living in the United States are required to provide tax ID and/or their social security number. Should their commissions exceed $600 for any calendar year, an IRS form 1099 will be issued, as required by law. Compliance Policy FreebieForce may change, alter, add, or detract conditions of representative status, membership, products, services, and compensation at any time and for any reason. FreebieForce reserves the right to terminate a representative or member at any time for violating any of our policies. Any controversy or claim arising out of or relating to the Agreement, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. If a Representative files a claim or counterclaim against FreebieForce he or she may only do so on an individual basis and not with any other Representative or as part of a class or consolidated action. Representatives waive all rights to trial by jury or to any court. All arbitration proceedings shall be held in Brighton, Colorado, unless the laws of the state in which an Affiliate resides expressly require the application of its laws, in which case the arbitration shall be held in the capital of that state. The parties shall be entitled to all discovery rights allowed under the Federal Rules of Civil Procedure. No other aspects of the Federal Rules of Civil Procedure shall be applicable to the arbitration. There shall be one arbitrator, an attorney at law, who shall have expertise in business law transactions with a strong preference being an attorney knowledgeable in the direct selling industry, selected from the panel, which the American Arbitration Panel provides. Each party to the arbitration shall be responsible for its own costs and expenses of arbitration, including legal and filing fees. The decision of the arbitrator shall be final and binding on the parties and may, if necessary, be reduced to a judgment in any court of competent jurisdiction. This agreement to arbitrate shall survive any termination or expiration of the Agreement. Louisiana residents may choose Louisiana law, jurisdiction, and venue. FreebieForce and its affiliates, officers, directors, employees, and other representatives shall not be liable for, and the Representative hereby releases the foregoing from and waives any claim for loss of profit, incidental, special, consequential, or exemplary damages which may arise out of any claim whatsoever relating to FreebieForce's performance, non-performance, act, or omission with respect to the business relationship or other matters between the Representative and FreebieForce whether sounding in contract, tort, or strict liability.
